Principles of Personal Information Protection

Fairuse Inc. (hereinafter referred to as the “Company”) conducts business activities with system development and sales as its core.

Personal information of customers and employees obtained through our business activities (including Specific Personal Information, etc.; hereinafter collectively referred to as “Personal Information”) is important information to the Company, and we recognize that ensuring its proper protection is an important social responsibility.

Based on the fundamental principles of the Act on the Protection of Personal Information (respect for individual dignity and protection of individuals’ rights and interests), the Company will provide “peace of mind” to customers and employees and fulfill its social responsibility by ensuring appropriate handling of Personal Information and continuously improving security control measures.

In addition to operating in compliance with the Personal Information Protection Management System (JIS Q 15001), the Company will continuously implement organizational and technical measures, including management based on the Information Security Management System (ISMS: ISO/IEC 27001).

Policy

  1. 1.Acquisition, Use, and Provision of Personal Information

    • We acquire Personal Information by lawful and fair means.
    • We use Personal Information only to the extent necessary to achieve the purposes of use.
    • When providing Personal Information to a third party, we will obtain the data subject’s consent in advance, except where permitted by applicable laws and regulations.
    • We will not use acquired Personal Information beyond the scope of the stated purposes. We will also take measures to prevent use beyond the scope of the purposes.
    • If it becomes necessary to use Personal Information beyond the original purposes, we will obtain consent for the new purpose(s) prior to such use.
    • With respect to Personal Information entrusted to us by business partners, etc. (information handled by the Company as an “entrusted contractor/processor”), we will handle such information only within the scope of the purposes, in accordance with the entrusting party’s instructions and the relevant contract(s).
  2. 2.Laws, Guidelines, and Other Norms Established by Each Country (collectively “Laws, etc.”)

    The Company endeavors to understand laws and regulations relevant to the business handling Personal Information (including the Act on the Protection of Personal Information, the Act on the Use of Numbers to Identify a Specific Individual in Administrative Procedures, the GDPR, and other applicable laws and guidelines), and will inform employees engaged in our business (hereinafter “Employees”) and ensure compliance.

  3. 3.Security Control Measures for Personal Information

    • To reduce risks such as unauthorized access, leakage, loss, or damage, we will establish and maintain a system that can promptly implement corrective actions.
    • We will conduct inspections, and if violations or incidents are discovered, we will promptly correct them and implement preventive measures against vulnerabilities.
    • We will thoroughly provide Employees with education regarding security control measures.
  4. 4.Complaints and Inquiries

    We will establish a “Personal Information Inquiry Desk” for complaints and consultations regarding the handling of Personal Information, maintain a system to respond promptly, and respond in good faith.

  5. 5.Continuous Improvement

    • The Company’s Personal Information Protection Management System monitors and audits compliance with internal rules and strives to identify violations, incidents, accidents, and vulnerabilities.
    • Management will conduct reviews, reflect the results in control measures and internal rules, and strive for continuous improvement.
    • Improvements will be made in compliance with Laws, etc. and JIS Q 15001 (and, as necessary, taking into account ISMS requirements).

Handling of Personal Information

This Policy sets out the Company’s overall policy for handling Personal Information in its business operations, taking into account not only handling under the Japanese Act on the Protection of Personal Information, but also the handling of personal data to which the EU General Data Protection Regulation (GDPR) applies.

Where the GDPR applies, this Policy describes the Company’s basic approach and response framework for handling personal data as a Controller or a Processor.

The Company’s Role as “Controller” / “Processor”

The Company may handle both:

  • Personal Information that the Company acquires and manages while determining the purposes of use, etc. (“information handled as Controller”); and
  • Personal Information that the Company handles on behalf of business partners, etc. under entrustment (“information handled as an entrusted contractor/Processor”).

For information handled as an entrusted contractor/Processor, we handle such information in accordance with the entrusting party’s instructions and contract(s), and, in principle, the Company may not be able to respond independently to requests for “disclosure, etc.”

Measures Implemented to Ensure the Secure Management of Retained Personal Data

Formulation of Basic PolicyThe Company publishes this Personal Information Protection Policy on its website.
Establishment of RulesWe establish rules for each stage such as acquisition, use, provision, storage, and disposal, including handling methods, responsible persons, and their duties, and review them regularly.
Organizational Security MeasuresWe conduct periodic self-inspections, internal audits, and (as necessary) external audits.
Human Security MeasuresWe obtain confidentiality pledges from Employees and provide periodic training.
Physical Security MeasuresWe manage restricted handling areas and implement measures to prevent theft of equipment and media.

Understanding of the External EnvironmentWe may use cloud services to store Personal Information, etc.
The locations of data centers for such cloud services may be in Japan or overseas.
The Company confirms that appropriate access controls and other safeguards are implemented by such cloud services, and endeavors to understand the personal information protection systems, etc. of countries/regions to which data may be transferred.

Retention Period (Supplement)

The Company retains Personal Information only for the period necessary to achieve the purposes of use, or for the period required under Laws, etc., and deletes or disposes of it appropriately when it becomes unnecessary. Purposes of use, required retention periods, and legally required retention periods may differ depending on individual products such as Real Time Translator. For details, please refer to the privacy policy for each product.

Requests for Disclosure and Inquiries to the Company

Procedures for Requests for Disclosure, etc. under the Japanese Act on the Protection of Personal Information and for Individuals Outside the EU/EEA

  1. When the Company receives a request from a data subject or their agent in Japan or outside the EU/EEA (e.g., the United States) regarding retained personal data held by the Company for: notice of purpose of use, disclosure, correction/addition/deletion, suspension of use, deletion, suspension of provision to third parties, and records of third-party provision (collectively, “Requests for Disclosure, etc.”), the procedures are as follows.

  2. 1.Where to Submit Requests for Disclosure, etc.

    Please submit the Request Form for Disclosure, etc. of Personal Information with the required documents attached, by email attachment or by postal mail.
    If submitting by postal mail, please use a method that allows delivery tracking (such as registered mail).
    Please write in red on the envelope: “REQUEST FORM FOR DISCLOSURE, ETC. OF PERSONAL INFORMATION ENCLOSED.”

  3. 2.Documents to be Submitted for Requests for Disclosure, etc.

  4. 3.Identity Verification

    To verify the identity of the requester, we will confirm by phone.
    If phone confirmation is not possible, we may request a copy of a document issued by a public authority that identifies the individual, such as a driver’s license, certificate of residence, health insurance card, etc.

  5. 4.Requests by an Agent

    If you authorize an agent, please enclose, in addition to the request form, the following documents:
    (1) Document to verify the agent’s identity (copy):
    One of the following: driver’s license, copy of certificate of residence, or health insurance card (insured person certificate).
    Please provide copies with the registered domicile (honseki) masked.
    (2) Power of Attorney:
    A power of attorney bearing the data subject’s seal and a certificate of seal registration.
    (If the agent is a legal representative such as a parent/guardian, other documents showing the relationship may be accepted.)

  6. 5.Fees for Requests for Disclosure and Notice of Purpose of Use

    For requests for disclosure of personal information and notice of purpose of use, a fee of JPY 500 (tax included) per request applies for requests from within Japan, and JPY 3,500 (tax included) per request applies for requests from outside Japan.
    Please pay the fee by bank transfer (account details will be provided during identity verification).
    Bank transfer fees are borne by the requester.
    If the fee is insufficient or payment cannot be confirmed, we cannot respond to the request for disclosure/notice of purpose of use.

  7. 6.Method of Response to Requests for Disclosure, etc.

    We will respond by the method specified by the requester (email or postal mail).
    (The time required may vary depending on the request content and status of identity verification; however, we will respond within a reasonable period in accordance with applicable laws and regulations.)

  8. 7.Name of the Authorized Personal Information Protection Organization and Where to File Complaints

    If you believe our handling of personal information is inappropriate, please first file a complaint with the Company.
    If you are not satisfied with the Company’s response, you may file a complaint with the following authorized personal information protection organization:

Requests under the GDPR (For Individuals Residing in the EU/EEA)

Where the Company handles personal data of individuals in the EU/EEA as a Controller, the Company processes such personal data primarily on the following legal bases:

  • Performance of a contract (GDPR Article 6(1)(b))
  • Compliance with a legal obligation (Article 6(1)(c))
  • Legitimate interests (Article 6(1)(f))
  • Consent (Article 6(1)(a)), primarily where consent is required, such as for cookies

Data subjects have rights including the right of access, rectification, erasure, restriction of processing, data portability, and objection.
For processing based on consent, you may withdraw your consent (withdrawal does not affect the lawfulness of processing before withdrawal).
You also have the right to lodge a complaint with a supervisory authority. Please submit your request in accordance with the procedures below.
